Terms & Conditions

By accessing primelinktelecoms.co.za or subscribing to any Prime Link Telecoms service, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

1. Definitions

In these Terms and Conditions, the following words shall bear the meanings ascribed to them below:

  • "Agreement" means these Terms and Conditions together with any service schedule, order form, or service level agreement.

  • "Customer" or "you" means any individual or entity that accesses our website or subscribes to our services.

  • "Prime Link", "we", "us", or "our" means Prime Link Telecoms (Pty) Ltd.

  • "Services" means LTE internet connectivity, data products, hardware supply, and any ancillary services provided by Prime Link Telecoms.

  • "ICASA" means the Independent Communications Authority of South Africa.

2. Services Provided

Prime Link Telecoms provides LTE-based internet access services across South Africa. Services are provided on a best-efforts basis over licensed national LTE networks. Speeds, latency, and availability may vary based on network conditions, location, device type, and simultaneous usage. PrimeLink Telecoms does not guarantee specific minimum speeds unless stated in a written service level agreement.

3. Subscription and Payment

  • All service subscriptions are billed monthly in advance or as otherwise stated on your service plan.

  • Payment is due on the date specified in your invoice. Late payment may result in service suspension.

  • All prices are inclusive of VAT at 15% where applicable.

  • PrimeLink Telecoms reserves the right to amend pricing with 30 days' written notice to active subscribers.

  • Debit orders returned unpaid may attract a bank charge which Prime Link Telecoms may pass to the customer.

4. Fair Use Policy

Uncapped data plans are subject to our Fair Use Policy. During periods of network congestion, customers who exceed usage thresholds may experience traffic management (speed reduction) to ensure quality of service for all users. This is in accordance with ICASA's End-User and Subscriber Service Charter Regulations.

5. Acceptable Use

You agree not to use our Services for any of the following purposes:

  • Any unlawful activity under South African law or applicable international law.

  • Sending unsolicited bulk email (spam) or operating spam-related services.

  • Conducting denial-of-service attacks or hacking activities.

  • Sharing your connection commercially without a reseller agreement.

  • Accessing or distributing child exploitation material.

  • Violating the intellectual property rights of any third party.

Violation of this clause may result in immediate service termination without refund and referral to law enforcement authorities.

6. RICA Registration

In terms of the Regulation of Interception of Communications and Provision of Communication-Related Information Act 70 of 2002 (RICA), all SIM cards and internet connections must be registered. By subscribing to our service, you consent to your identity documents and address being used to fulfil PrimeLink Telecoms' RICA obligations. Providing false information is a criminal offence under RICA.

7. Suspension and Termination

Prime Link Telecoms may suspend or terminate your service:

  • If you fail to pay any amount due after 7 days' written notice

  • If you breach any material term of this Agreement and fail to remedy the breach within 10 business days of notice

  • If you use the service for illegal purposes

  • If we are required to do so by any regulatory authority or court order

You may terminate a month-to-month subscription with 30 days' written notice. Fixed-term contracts are subject to early termination fees as permitted by the Consumer Protection Act.

8. Limitation of Liability

To the maximum extent permitted by South African law, Prime Link Telecoms' liability to you in connection with any service failure, interruption, or defect shall not exceed the total monthly subscription fee paid by you in the month in which the incident occurred. We shall not be liable for indirect, consequential, or special damages.

Nothing in this clause limits liability for death, personal injury, or gross negligence, nor does it affect your rights under the Consumer Protection Act.

9. Intellectual Property

All content on primelinktelecoms.co.za, including text, graphics, logos, and software, is the property of Prime Link Telecoms or its licensors and is protected by South African copyright law and the Copyright Act 98 of 1978. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Governing Law & Disputes

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from this Agreement shall be subject to the jurisdiction of the South African courts. Before escalating to legal proceedings, the parties agree to attempt resolution through good-faith mediation for a period of 30 days.

Alternative dispute resolution is also available through the Consumer Goods and Services Ombud (CGSO) for applicable consumer disputes.

11. Amendments

Prime Link Telecoms reserves the right to amend these Terms and Conditions. Material amendments will be communicated to active customers with at least 30 days' notice. Continued use of our services after the effective date of any amendment constitutes acceptance of the updated terms.

12. Applicable Legislation

  • Electronic Communications and Transactions Act 25 of 2002 (ECT Act).

  • Consumer Protection Act 68 of 2008 (CPA).

  • Electronic Communications Act 36 of 2005.

  • ICASA End-User and Subscriber Service Charter Regulations, 2016.

  • Regulation of Interception of Communications Act 70 of 2002 (RICA).

  • Protection of Personal Information Act 4 of 2013 (POPIA).
